These terms govern your use of XPENG Owners UK community platforms, including our social media pages and groups, our community hub, website, and any future digital channels (together, the "platforms"). By participating in any of our platforms, you agree to these terms.

In these terms, "we", "us" and "our" refers to Elevare Insights Ltd, trading as XPENG Owners UK. "You" refers to any individual using or participating in our platforms. "Content" means anything you post, submit, or contribute to our platforms, including posts, comments, poll responses, images, and other material.
1. Who Can Join
Our community is intended for adults aged 18 and over. By joining, you confirm that you are at least 18 years old.
Membership is subject to approval. We reserve the right to decline or remove membership at our discretion, including where these terms or our Community Rules have been violated.
2. Community Rules
Your use of our platforms is subject to our Community Rules, which form part of these terms. Violating our Community Rules is a violation of these terms and may result in suspension or removal.
Our Community Rules cover expected standards of behaviour, acceptable content, and how we manage commercial activity within the community. They are published and pinned within our platforms.
3. Acceptable Use
When using our platforms you must not:
- Break any applicable law or regulation.
- Impersonate any person or organisation, or misrepresent your affiliation with any entity.
- Post spam, unsolicited commercial messages, or promotional content without our prior permission.
- Harass, threaten, or abuse other members.
- Post content that is unlawful, defamatory, discriminatory, or otherwise harmful.
- Attempt to gain unauthorised access to any part of our platforms or systems.
- Use automated tools to scrape, extract, or monitor our platforms without prior written permission.
- Disclose confidential information belonging to others, including personal data of third parties.
- Post content that infringes any third party's intellectual property rights.
- Encourage or assist others to violate these terms.
4. Your Content
You retain ownership of content you post to our platforms. By posting content, you confirm that you have the right to do so and that your content does not infringe the rights of any third party.
You are solely responsible for your content. We do not endorse or verify content posted by members.
By participating in our community platforms, you grant XPENG Owners UK a non-exclusive, royalty-free licence to use, analyse, and create derivative works from your contributions for community management, market intelligence, manufacturer feedback, and trend analysis purposes, including through automated and machine learning techniques. This licence is limited to anonymised and pseudonymised processing. You retain ownership of your content. We do not republish identifiable content without explicit permission.
We reserve the right to remove any content that violates these terms or our Community Rules, or that we consider inappropriate, without notice.
5. Moderation & Enforcement
We reserve the right to moderate, edit, remove, or restrict content and accounts at our discretion. All moderation and enforcement decisions are made solely by us. No third party has authority to make moderation or enforcement decisions on our behalf.
Where we believe a legal obligation requires it, we may cooperate with law enforcement or regulatory authorities.
6. Commercial Activity
Unsolicited commercial content, advertising, or promotional activity is not permitted without our prior written agreement. This applies to all participants including dealers, suppliers, and commercial organisations.
We may facilitate commercial activity on our platforms — including events, digital products, and referral arrangements — under separate agreements. These terms govern general platform use only.
7. Intellectual Property
All platform design, branding, methodology, intelligence frameworks, and proprietary systems are our exclusive property. Nothing in these terms grants you any rights in our intellectual property.
We are an independent community operator. Use of XPENG-related terminology is descriptive only and does not imply endorsement or affiliation with XPENG Motors, IM Group, or any manufacturer or dealer.
8. Privacy
Your use of our platforms is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. Our Privacy Policy forms part of these terms.
9. Disclaimers
Our platforms are provided for community and informational purposes. We do not warrant the accuracy, completeness, or reliability of any content posted by members.
Content posted by members reflects their personal views only. We are not responsible for content posted by members or for the actions of third parties.
10. Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, or consequential loss arising from your use of our platforms or reliance on any content posted within them.
Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.
11. Termination
You may leave our community platforms at any time. We may suspend or remove your access at any time if we believe you have violated these terms or our Community Rules.
The licence grant in Section 4, the intellectual property provisions in Section 7, and the disclaimers and liability provisions in Sections 9 and 10 survive termination.
12. Governing Law
These terms are governed by the laws of England and Wales. Any disputes arising from these terms or your use of our platforms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Changes to These Terms
We may update these terms periodically. New versions will include an updated "Last Updated" date. Where changes are material, we will notify community members through a transparency notice published on our platforms.
